I personally, have never seen a situation where high RPM/speed reverse is warranted either, except when Pot-heads try to back themselves out of a Christmas tree. It seldom ever gets you unstuck, and is usually only used for low-speed off loading and manuevering situations. IMO: That is what it should be restricted or governed to.
This is also what confuses me, what is the need for 10,400+ RPM's in reverse?
Either way, yes the throttle wasn't stuck when I started it, it stuck when I hit the throttle to start to back up. And yes the throttle was still frozen open after I was flung into the street and the sled was on its side, the track was still spinning while on its side, I quickly went for the kill switch at this point.
I know the head mechanic at the shop pretty well, I grew up with him, while I was over talking to the owner today he came along and asked me what happened, when I told him the story he himself couldn't believe that someone had washed the sled down with water and put it outside.
I'm not surprized by my dealers reaction, it is actually what I expected from him, I know what he is like, its just too bad he is the only dealer for Yamaha, Polaris and Arctic Cat within 700km. And the Ski-doo dealer is just as bad.
Also while I don't like the idea of even involving an attourny that may eventually have to become an option. After the accident my tailbone was sore, atm the pain has spread to my lower back and legs. I guess we will have to see what happens.

What??? People need to take some responsibility for their actions. If there is a defect in the sled that's one thing but not checking throttle and brake operation before starting is another. I was taught at an early age to squeeze the throttle and brake before starting. That would have prevented this accident. The same goes for ME falling against the bars...this isn't a design flaw or Yamaha's fault and I certainly don't need the sled redesigned to accomodate my mistakes!! This is a dangerous sport be more careful and check YOUR equipment BEFORE you start it. It's not hard.

How about a guy who lined up with his buds on a lake and LEAVES IT REVERSE BY MISTAKE......then PINS IT.
Who's fault is that? I "might know a guy" who did that 4 or 5 years ago.....my ego ....I mean HIS ego was decimated....

Something tells me we are not getting the whole story here. Corins where are you from? Seriously now did you screw up and make that up so the dealer would cover the damage or did the dealer really wash it leave it outside? Sorry but the story seems to keep changing here. Furthermore I still cant see a dealer washing the sled leave it outside to freeze have that happen legitimately and they not do anything to help or fix it.

I teach my 11 and 12 year olds in snowmobile safety the following...1) Before starting you sled make sure it is pointed in a safe direction 2) Before starting the sled make sure the throttle and brake move freely and when released, go back to their original position.
I feel for you man but you obviously disregarded some very basic procedures that are common knowledge in snowmobiling. Your dealer washing your sled and leaving it outside was a bone-head move but it is your responsibilty as the operator of that snowmobile to check your throttle and brake prior to starting not your dealer. IMO you have no reason to get a free set of bars and If I was your dealer I would NOT give you anything.

I really don't think a law suit is the answer you'll lose! Hopefully this teaches you like i hope it teaches many of the rest of us (myslef included) to do those pre ride checks before EVERY ride. :ORC Hope the tail bone gets better but IMO neither Yamaha, or your dealer are totally responsible for this incident it was a combination of events, timing and bad luck. Just be happy you did'nt hit anybody! Either that or move to the Midwest where all we do is stare at our sleds as they sit in the garage waiting for snow.

I think we arn't getting the whole story here. When your in reverse.. you normally tap the thottle lightly anyways. Something tells me he punched it and though it was in fwd gear and it wasn't.

I am gonna say that it was possible to tap the throttle a little hard, and as you know, it can surprise you!! Then he would do the (what I have official named) the 'DoktorC' front flip over the handlebars! I give him a 9.8 for his efforts, a 9.2 for damage, and a 9.7 overall.
However, with that being possible, I say it could have happened, but only for that reason, and not due to a frozen throttle lever.

when I bought my apex last year it was my first yamaha and I hated the backup beeper having come from polaris which didn't have one,one day the beeper stopped working and I thought to myself great saves me having to disconnect it,it wasn't long after that I pulled into a busy gas station to fill up and pulled up to the wrong pump ,so I put it in reverse backed up to the proper pump,I filled up and was about to go in to pay and I decided to be a nice guy and move my sled first so the people waiting could fill up,well you can guess what happened ,nailed it and over the bars I went very embarrassing to say the least, everybody got a good laugh,and I just got a bruised ego,.needless to say I got that annoying beeper fixed over the summer(only warranty work I had to get onthis sled).,a little off topic but shows how easy it is to do the forgotten reverse over the handlebars thing.[/i]
