Yet another horribly written law by our completely wacked out DNR. Seriously, this is a hunting case? This is cruelty, not a damn hunting case. Do you think these boys thought of this and knew the loophole when they slatughtered those animals? Absolutly not, and what a crock that these guys are getting out of this without a felony. I don't necessarily have a problem with the lawyers in this case. It sounds like any rookie lawyer could've figured out that the animal cruelty laws may not cover deer. Sometimes being a good defense lawyer isn't about "getting someone off" as it is about exposing poorly written laws. I hope the clowns in Madison are preparing a bill that will close the potential loophole. But they are probably too busy trying to figure out new ways to ban smoking, raise gasoline taxes, and allow illegal aliens access to UW college system at in-state tuition prices.
My issue is with the Prosecutor. Grow a pair and push on with the felony charge - I'm pretty sure they could get a jury to convict even though the law is ambiguously written.
I thought they were riding STOLEN snowmobiles?Where is that charge?Should be a felony for that.How about trespassing since obviously they werent on the trail while doing this.Makes me sick they are basicly going to get out of this.

What an Idiot there are places for those people!!! Bring it out to the track. Those that real cocky on the track find a berm real quick!!! Or is he wants to ride fast on the trail go to a cross country race, except they are not groomed trails see what he's really made of!!!
I love to race and ride hard but the trails are not the place for it. On the track everyone understands the risks and has signed up for it. not everyone who rides the trails wants to or should assume the same risks.
Heck its almost to the point I am afraid to take my family on a ride do to idiots on the trails

Van Hollen says he will appeal because he believes the Waupaca County circuit judges improperly interpreted the law.
Two different judges dismissed the felony animal cruelty charges against 24-year-old Rory Kuenzi and his brother, 23-year-old Robby Kuenzi. They also face various hunting violation charges.
The judges ruled that since the brothers were hunting at the time, state law prohibits them from being charged with animal cruelty.
Nicholas Hermes, 23, faces similar charges and is due in court July 22.
