One of them was in court today

WAUPACA COUNTY - One of the suspects in the Waupaca County case accused of running down five deer and killing them was back in court Tuesday.

A balance of initial appearance for Nicholas Hermes was held, but the next step - a preliminary hearing still has not been scheduled.

The other two suspects, Robby and Rory Kuenzi, also face charges.

Rory Kuenzi is expected back in court on the deer charges in early February. His brother Robby Kuenzi will have his next court date set this week.

Amazing how a little media attention makes people do there jobs. A bungled reconstruction effort.

As you and I had mentioned, these Idiots are just that, Idiots.
And on their way to murder, or have already done so.

(I had no idea, other than by the type of people they are, you know it is almost inevitable.)

Don't be mislead by hype, these type of people will never be "fixed" by a club, or any other normal means you and I think of.
Harassment of the average rider just hurts us, not them.

When the Law goes back to "To Serve and Protect", I will strongly support them and encourage their involvement in our lives.
Unfortunately, they have moved FAR away from that, and their involvement is, and for the foreseeable future will be, a very negative thing.

The club issue itself has nothing to do with this whatsoever.
Besides, do you REALLY want this kind of person in your club?

Who issues the licenses to hunt the deer? I'd argue that all wild animals are owned or protected by someone in some manner of speaking. Be it the ministry, state or whoever has the power and control over regulations of hunting any game and controlling the seasons to be extended, issuing tags or sort would and should be able to claim ownership of said game to counter this bullcrap arguement. Call the prosecution if anyone knows if this will works. I'm not a hunter and don't know the rules and regulations but it's gotta raise an eyebrow,. That;s exactly what the defence is trying. If the defence wants to make this a joke beat'em to the punch line.
 
Does anybody remember the times when you were beheaded for hunting the kings deer? I strongly believe someone can claim ownership for these deer. Hondo might be the only guy old enough to recall these times...LOL!! Hope you guys over there can help put these guys away. Anyone I've told this story to was throughly disgusted by these riders actions, hunter or flower sniffer.

I have never heard of such descusting act in all my life,these idiots should be rounded up,and tied to a tree,with bear bait at the bottom of the tree. My God can you imagine what that poor women who ownes the land is thinking,if i owned the land i would have shut it down too,and only opened it if the criminals were caught and procecuted to the max!!!
 
Wow tell me this rory ahole guy dont look like a criminal,and the list of hunting troubles he has had in the past,should seal his fate,but wait good lawyers will always prevail!! Man this is when we should have a good old fashened linching..
 
We just had a trail shut off. The land owner was with his kids walking and he made a hand jesture to slow down to a snocross wanna bee and the wanna bee gave him the finger. He shut the trail down and bull dozed it as well.

There should be some kind of program to have out there to educate and or punish these guys who don't care about trail safety and politeness.

A second judge in the Waupaca deer slaughter case gave the prosecutor until Monday to drop the felony mistreatment charges or the misdemeanor illegal hunting charges against Rory Kuenzi, 24.


The decision comes on the heels of dismissed felony charges against a co-defendant.


Judge Philip Kirk, in what turned into a dressing down Wednesday of the Assistant Dist. Atty. James Fassbender, was clearly irked at what he called a "goat rodeo" in the myriad charges filed against Kuenzi and his two- co-defendants in a high-profile case that is showing signs of unraveling.


"These charges are inconsistent," Kirk said. "You have to decide what you want to do."


Kirk agreed with Public Defender Troy Nielsen's argument that the state "cannot have it both ways."


Kuenzi, his brother Robby Kuenzi, 23, and Nicholas Hermes, 23, are accused of running down and killing a group of deer with their snowmobiles Jan. 9 in the Town of Lind. They also face a laundry list of state Department of Natural Resources citations.


Kirk's decision mirrors in many respects the decision reached by Judge John Hoffmann, who is hearing the case against Robby Kuenzi. At a June 11 hearing, Hoffman dismissed the felony mistreatment charges against Robby Kuenzi ruling they were incompatible with the companion hunting violations.


"And it is because of your charging decision," Kirk said. "Overcharging is the swine flu of the criminal justice system."


Kuenzi is charged with six counts of felony mistreatment of an animal causing death and six misdemeanor counts of hunting out of season. Under the statutes, hunters cannot be charged with mistreatment of animals.


Kirk read the text of the misdemeanor hunting complaints out loud, noting that they are identical to the animal cruelty complaints.


"So is this 'venicide' or really bad hunting?" Kirk asked. "What is it?"


Kirk also signaled he would be setting a high legal threshold if the state chooses to pursue the animal cruelty charges.


"That does not necessarily mean that hunting is not a factual issue in the underlying offenses," said Kirk. "You get to decide how you want to prosecute this case."


Fassbender declined comment as he left the courtroom.


The three defendants have different judges hearing their cases. Hermes' case is on hold while the legal issues in the other cases are untangled. A status conference for Hermes in front of Judge Raymond Huber is set for July 22.


The other two defendants originally were charged with nearly identical charges as Rory Kuenzi — five animal cruelty and hunting out of season charges rather than six
